According to the Ministry, pursuant to article 64 of the Economic Code of Ukraine any company shall independently determine its organizational structure, number of employees and list of positions and salaries.
Considering the need to regulate and protect the rights of the employees to labor, protection from illegal dismissal and labor remuneration the list of positions and salaries must be approved by each company. Failure to approve such a list by the company shall be deemed a violation of labor protection legislative requirements and may result in administrative fine charged to the employer in compliance with part 1 of article 41 of the Code on Administrative Violations of Ukraine.
